مواجهة الفجوة المعرفية الرقمية في قواعد القانون المدني الأردني, دراسة في حماية الرضا التعاقدي في عصر الذكاء الاصطناعي

الملخص

هدف البحث إلى الكشف عن ماهية الفجوة المعرفية الرقمية؛ باستعراض انعكاساتها على سلامة الرضا، ورصد وسائل الذكاء الاصطناعي، وآلياته المستخدمة في التلاعب بالإرادة الرقمية، ولتحقيق أهداف البحث تم اعتماد المنهج الوصفي باستخدام أسلوب تحليل المضمون. وأظهرت أبرز النتائج أن أحكام عيوب الإرادة التقليدية: غير كافية لحماية الرضا في العقود الرقمية؛ نظرًا لطبيعة التضليل البرمجي الخفي والتلاعب الخوارزمي بالاعتماد على البيانات الشخصية، بناء على ذلك تمثلت أبرز التوصيات بضرورة تبني الأطر التشريعية التي تُلزم الشركات التقنية بشفافية خوارزمياتها؛ لمنع الاستغلال غير الأخلاقي للبيانات الشخصية في التوجيه السلوكي.

abstract

The research aimed to uncover the nature of the digital knowledge gap by reviewing its implications for the integrity of satisfaction, and to monitor artificial intelligence methods and mechanisms used to manipulate digital will. To achieve the research objectives, the descriptive approach was adopted using the content analysis method. The most prominent findings showed that the provisions of traditional defects of consent are insufficient to protect consent in digital contracts, given the nature of hidden software deception and algorithmic manipulation based on personal data. Accordingly, the most prominent recommendations were the need to adopt legislative frameworks that obligate technology companies to be transparent about their algorithms in order to prevent the unethical exploitation of personal data in behavioral guidance
